In an unprecedented move during Pride Month, President Joe Biden has pardoned thousands of veterans who were convicted under a long-standing ban on gay sex within the military. Scope of the Pardon
The presidential proclamation targets Article 125 of the Uniform Code of Military Justice, which criminalized sodomy, including consensual acts, from 1951 to 2013. The “full, complete, and unconditional pardon” will impact an estimated 2,000 veterans. Although this pardon does not automatically amend their records, it allows the affected individuals to apply for a certificate of pardon, facilitating access to previously withheld benefits.
Exclusions and Further Actions
The pardon excludes individuals convicted of nonconsensual acts, such as rape. Nonetheless, Biden expressed his commitment to considering pardons for other LGBTQ+ veterans convicted under different circumstances.
